Affidavit of service filed by the petitioners be kept with the record.

Learned advocate appearing for the petitioners complains that the petitioner no.1 is an aged lady and the petitioner no.2 is her daughter who are being deprived by the respondent nos.8 to 10. State has submitted a report. Report reflects the statement of the mother/petitioner no.1 wherein it is seen that the mother has informed the police authorities that it is respondent no.8 who is taking her care and there are certain allegations against the petitioner no.2.

Be that as it may, I find that the writ petition has been affirmed by the petitioner no.2 on behalf of the petitioner no.1. Prima facie, it seems that the

rivalry is between the petitioner no.2 and the respondent no.8 for which the mother/petitioner no.1 is being used.

In view of the aforesaid, I direct that if there is any difficulty faced by the mother/petitioner no.1, she would be at liberty to approach the authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. In case there are other issues involved with regard to property, parties would be at liberty to approach the jurisdictional civil court. With the aforesaid observations, WPA 24860 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
