Advocate for the petitioner is aggrieved by the pendency of the interim prayers in connection with C.C. No. 42 of 2022 pending before ld. Addl. Judicial Magistrate, 1st Court, Bashirhat.

Ld. Advocate submits that on 6th of April, 2022, an application was filed by the present petitioner for interim relief(s) along with other prayers in paragraph 13 and prayer (xi). There was a prayer also for custody and visitation of the minor child, which is, till date, pending. The next date of the case, as has been informed, is fixed on 2nd of November, 2023.

Accordingly, the ld. Additional Judicial Magistrate is directed to dispose of at least the prayer of custody of the child on 2nd of November, 2023.

If any of the parties on the date so fixed is absent, in that case, the ld. trial Court would issue notice and fix date

within a fortnight to hear out the parties and dispose of the prayer for custody of the child positively by 20th of November, 2023.

With the aforesaid observations, CRR 3949 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
