Learned Counsel for the respondent, with commendable fairness, submitted that no final assessment order has been passed by the authority under Section 126 of the Electricity Act. Learned Counsel for the respondent further contended that the petitioner is entitled to file a written objection and the same shall be decided by the authority concerned within a period of two weeks.

Learned Counsel for the petitioner unequivocally stated that such an objection shall be filed within a period of two weeks from the date of this order. Consequently, the authority concerned is directed to adjudicate upon the said objection in accordance with law within a further period of four weeks thereafter.

It is hereby clarified that in the event of the petitioner's failure to submit the written objection within the stipulated time period, the authority

concerned shall be at liberty to proceed ex parte and the authority shall pass the final assessment order in accordance with the provisions of Section 126 of the Electricity Act, 2023.

With the above directions, the present writ petitioner is disposed of.
