Advocate appearing for the petitioners submits that the petitioners are in custody and although charge was framed on 21.8.2023, but, till date, none of the witness has been examined. The next date has been fixed on 5th of April, 2024.
The petitioners, being in custody for about one year and seven months, have caused agony and, as such, ld. Special Court would see to that a schedule is fixed consisting of three dates and fix such schedule once in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
No unnecessary adjournment be granted to any of the parties. In case, any witness is absent, the concerned Superintendent of Police of the concerned district would be
informed so that steps are taken for ensuring the availability of the witnesses concerned.
In case, any of the witness is absent, the Superintendent of Police of the concerned district would submit a report narrating the reasons which are beyond the control for non-availability of the witness concerned. Ld. Public Prosecutor conducting the case would produce the materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. Trial court to conclude the trial at the earliest.
With the aforesaid observations, CRR 3948 of 2023 is disposed of.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
