Dumdum Police Station Case No.1029 of 2021 dated 13th September, 2021 under Sections 341/323/506 of the Indian Penal Code was registered on the basis of a written complaint submitted by opposite party No.2, Proma Mallick against her husband alleging, inter alia, that her husband had assaulted their minor daughter aged about 13 years.

During pendency of the case, the dispute between the parties have been amicably settled. The alleged offences are all compoundable in nature. Both the parties have filed a joint application for compromise stating, inter alia, that their dispute has been amicably settled.

A police report was called for which has been submitted by the learned Public Prosecutor-in-Charge. On perusal of the police report, I found that the dispute has been settled voluntarily by the parties without any threat, coercion and undue influence. Therefore, the settlement is accepted.

In view of such out of Court settlement, Dumdum Police Station Case No.1029 of 2021 dated 13th September, 2021 presently pending before the learned Additional Chief Judicial Magistrate at Barrackpore be quashed.

Both the revisional application and connected application are disposed of.

The report be kept with the record.
