Hossain ... for the petitioner Mr. Dipankar Mahata ... for the State The petitioner has prayed for expeditious disposal of NDPS Case No. 29 of 2022 arising out of Hariharpara P.S. Case No. 39 of 2022 dated 20.1.2022. The said case is pending before the ld. Judge, Special Court under NDPS Actcum-ADJ, 5th Court, Berhampore. It has been submitted that out of the 14 witnesses so cited in the charge-sheet, till date, none of the witnesses has been examined although charge was framed on 23rd August, 2023.

Having considered the anxiety so expressed by the petitioner, I am of the view that the same is justified. Accordingly, the ld. Trial court is directed to fix a schedule on and from the next date so fixed consisting of three dates and fix such schedule once in every 45 days so that the trial of the case is concluded within a reasonable

period of time. No unnecessary adjournment be granted to any of the parties.

In case, any of the witness is absent, the ld. Special Court will directly communicate with the Superintendent of Police, Murshidabad, who would take steps for ensuring the availability of the witness concerned or, in the alternative, submit a report regarding the reluctance of the witness to appear before this court. Ld. Public Prosecutor conducting the case would produce the materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders will cooperate with the ld. Trial court for concluding the trial at the earliest. With the aforesaid observations, CRR 3950 of 2023 is disposed of.

Pending application, if any, is also disposed of. Report so submitted by the ld. Advocate for the State be kept with the record.
