This writ petition has been pending since 2010. The petitioner assails a decision pertaining to pension under the Swatantrata Sainik Samman Pension Scheme of the Central Government.

The matter had appeared as an "Old Matter"

on August 30, 2024, when an accommodation was sought for on behalf of the petitioner.

It is submitted on behalf of the petitioner that both the original petitioner and his wife had expired during the pendency of the writ petition. The respondent authorities are represented and submit that criteria for entitlement of the Scheme are not applicable. In any case the right of the petitioner does not survive. As such, the instant writ petition has become infructuous.

In view of the fact that the petitioner is not in a position to proceed with the matter and has

repeatedly sought adjournment after more than a period of 14 years, WPA No. 20772 of 2010 stands dismissed for default.

Interim orders, if any, stand vacated.
