The petitioners are aggrieved by the fact that she being a widow had been constructing in the land which was owned by her husband. However, the private respondent no.6 had been obstructing and/or threatening the petitioners in such construction work. To that effect, she has informed the Inspector-in-Charge, Baishnabnagar Police Station.

Learned advocate for the State has submitted a report. The said report reflects that on receipt of the complaint of Nekaran Bibi, the police authorities have already drawn up proceedings under Section 126 BNSS being Baishnabnagar P.S. G.D.E. No. 553/2024.

In view of the police authorities being of the belief that there is possibility of breach of the peace and tranquility, I direct the Inspector-in-Charge, Baishnabnagar Police Station to keep a strict vigil and ensure that no untoward incident takes place at the locale in respect of the subject-matter of the property referred to in the writ petition.

With the aforesaid observations, the writ petition being WPA 24885 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
