Sr. St. Counsel, Ms. Ipsita Banerjee ...for the State The petitioners sought permission of the Commissioner of Police, Kolkata to stage the peaceful demonstration in front of the statue of Mahatma Gandhi on and from November 1, 2022, which has not been responded to.

Counsel for the State submits that as on the date of the petitioners' application, there were four other groups demonstrating in the said area and there was no space to permit any further demonstration. As on date, one group has left. The petitioners can, therefore, be permitted to conduct their peaceful demonstration.

Let such demonstration be permitted on the terms and conditions as may be stipulated by the office of the Joint Commissioner of Police

Headquarter. The permission may be granted to the petitioners initially for a period of 40 days. With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
