The revisional application has been filed for quashing of M. Ex 487 of 2024 pending before learned Judicial Magistrate, 5th Court at Alipore, South 24 Parganas.

Learned Counsel for the petitioner submits that the entire matrimonial dispute between the parties have been settled and the petitioner has paid the total agreed sum to the opposite party-wife. However, learned Counsel submits that the execution proceedings are still continuing and the same may be quashed. 3.

The Court has gone through the records. The order dated 09.10.2025 passed by the learned Judicial Magistrate indicates that upon an application made by the petitioner-husband for recalling of warrant of arrest, the warrant of arrest was kept in abeyance. The application for recalling is still pending disposal before the learned Judicial Magistrate.

Since the application is pending disposal, the Court considers that the revisional application is premature. Learned trial Court is directed to dispose of the application for recalling of warrant of arrest expeditiously.

Accordingly, the present revisional application is disposed of.
