AD 78 November 21, 2025 Ct. 28 SG CRM(A) 3550 of 2025 Partly Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chakdah Police Station Case No.1040 of 2025 dated 11.09.2025 under Sections 329(3)/117(2)/118(2)/351(3)/ 110/3(5) of the BNS, 2023.

Safikul @ Sofikul Alam Mondal and others ... petitioners Mr. Shibaji Kumar Das ... for the petitioners Mr. Bitasok Banerjee Mr. Tirupati Mukherjee ... for the State Learned counsel for the petitioners submits that a fight took place between the children of neighbours and the parents allegedly joined in. The first case was started from the petitioners' side. Injuries were received by both the sides, but none was grievous.
Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the statements of the victims which show that the victims were assaulted with hammer, iron rod, fist and blows. A victim lady lost her teeth. There were scalp injuries and dislocation of shoulder of other victims.
Considering the materials available in the case diary and the alleged roles ascribed to the present petitioners, while I am inclined to grant anticipatory bail to the petitioner No.2,
the application for anticipatory bail of the petitioner Nos.1, 3 and 4 (Safikul @ Sofikul Alam Mondal, Sohul @ Soyel @ Soyal Rana Mondal and Saraful Haque @ Hoque Mondal) is rejected.
In the event of arrest, the petitioner No.2(Ajifa Mondal @ Mary Mondal) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner No.2 shall cooperate with the investigation and shall not threaten or intimidate witnesses.
The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
