Learned advocate appearing for the petitioner submits that the petitioner and the victim girl eloped and subsequently the case was registered for investigation and ended in final report 'mistake of fact'. Father of victim girl thereafter filed Narazi Petition, consequent to which the case was reopened and charge-sheet was submitted. Petitioner's initial bail was cancelled and he was taken into custody. The investigating agency on conclusion of investigation submitted charge-sheet under the relevant provisions of IPC as well as the POCSO Act.

Learned advocate for the State on the other hand opposes the prayer for bail and draws the attention of the Court to the statement of the victim girl as well as the medical reports which corroborates the statement made by the victim before the Judicial Officer.

Having regard to the same, I am of the opinion that this is not a fit case for granting bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 2114 of 2025 is dismissed.

Report submitted by the State in respect of service effected upon the private opposite party be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
