The petitioner claims that he entered into an agreement with the private respondent to borrow sums of money against security and/or sale of a portion of his property.

The petitioner was unable to repay the same and sought time. The private respondent has encroached upon the house property according to the petitioner, which is not part of the agreement with the private respondent.

Officer-in-Charge, Chandipur Police Station has filed a report dated 20th February, 2023 and the same is taken on record.

It appears from the report that the petitioner does not even reside in the said village. The house in question is under lock and key.

This Court is of the view that the dispute between the petitioner and the private respondent is civil in nature. The parties may agitate their grievances before an appropriate civil forum in accordance with law. However, Chandipur Police shall ensure that there is no breach of peace in the area.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
