Vide order No. 44 dated 04.04.2013 learned Additional Sessions Judge, Siliguri had disposed of the revision petition dated 23.02.2007 with an observation that " the submission of enquiry as raised by revisionist counsel before this Court has become redundant one when already accused person/revisionist appeared before the Court below for facing further proceeding of this case".

The instant revisional application has been filed quashing of complaint being C.R. Case No. 575 of 2006 pending before the learned Judicial Magistrate, 1st Class at Siliguri. At the time of admission of the revisional application for stay of the proceedings pending before the trial court was not granted. The trial court must have concluded the hearing of the aforesaid complaint case and decided the issue in question.

The opposite party No.1 has expired on 15.07.2016. Under such circumstances, this Court does not find any reason to interfere with the order passed by the learned Additional Sessions Judge, Siliguri.

Accordingly, the instant revisional application is dismissed.

Lower court records along with a copy of this order be sent down at once to the learned trial court for necessary information. (Ananya Bandyopadhyay, J.)
