31.10.2025 SL No. 10 Ct No. 22 SB CRR 3451 of 2017 Goutem Sen Vs.

State of West Bengal & Anr.

1. It appears that an inadvertent typographical error has crept into the Order dated October 24, 2025, previously passed in this revision.

2. At the conclusion of Paragraph 3 of the said Order, the date for listing was erroneously recorded as "31.11.2025". The correct and intended date was October 31, 2025.

3. The said typographical error is hereby corrected. The Order dated October 24, 2025, shall henceforth be read conjointly with this Order, with the date of listing amended to October 31, 2025.

4. It is observed that none appears on behalf of either of the parties, confirming the previous instances of nonrepresentation.

5. Considering the history of non-prosecution by the parties, this Court deems it necessary to proceed to pass an order on the basis of the materials available with the record to prevent further unnecessary prolongation of this revision.

6. The instant Revisional Application, preferred by the Petitioner, Mr. Goutem Sen, under Sections 482 and 401 of the Code of Criminal Procedure (Cr.P.C.), challenges the Order dated May 20, 2017, passed by the Learned Judicial Magistrate, 6th Court, Howrah. The challenge is specifically directed against the rejection of the prayer made by the Petitioner under Section 205 of Cr.P.C. in Complaint Case No. 1714C of 2015.

7. Upon a careful examination of the record and the impugned order, this Court finds no illegality or impropriety warranting intervention under its revisional or inherent jurisdiction. The discretion exercised by the Learned Magistrate falls within the bounds of law.

8. Accordingly, the Criminal Revision is dismissed.

9. The interim order, if any, granted previously in this revision, stands vacated.
