1. Affidavit-of-service filed be kept with the record.

2. The writ application has been preferred challenging a notice dated May 21, 2025 issued by the respondent no.2 for recovery of the alleged demand in respect of interest and damages for the period from April 1996 to February 2013, January 2014 to September 2015, January 2014 to September 2017 and April 2018 to March 2019 under section 14B and 7Q of the Employees Provident Fund and Miscellaneous Provisions Act 1948.

3. On hearing the Learned Counsel for the petitioner and on perusal of the materials on record, it appears that the order under Section

14B and 7Q of the EPF Act is dated 20.09.2016.

4. The petitioner has approached this Court being aggrieved with a notice to show cause why a warrant of arrest should not be issued for non-compliance of repeated orders since, 2016. The said notice to show cause is dated 21.05.2025.

5. The petitioner herein has prayed for protection from this Court.

6. Considering that the date of hearing was fixed on 4th June, 2025 and the final result of the said hearing has not been place before this Court, this Court finds that the conduct of the writ petitioner herein does not call for any sympathy and this Court finds no reason to interfere with the proceedings initiated by the defendant authority concerned.

7. But considering the prayer of the petitioner who submits that he is willing to make the payment, the petitioner is at liberty to approach the appropriate authority, Recovery Officer, Regional Office Howrah and pray for an order for payment by installment, which the authority concerned shall consider sympathetically.

8. The writ application being WPA No. 24294 of 2025 stands disposed of.

9. Applications, if any, connected thereto stands disposed of consequently.

10. Interim order, if any, stands vacated.

11. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
