Learned advocate for the petitioner is aggrieved by the factum of encroachment upon his land, which is opposed by the learned advocate appearing for the respondent nos. 5 to 7.

The issue relating to whether the property has been encroached or not is in absolute domain of the civil court. This court will not interfere with in so far as the right, title and interest of a property is concerned.

The petitioner would be at liberty to renew his prayer which are akin to the prayers advanced in this writ petition before the jurisdictional civil court. Learned advocate for the petitioner submits that in the property the petitioner is carrying on a grocery shop.

The police authority will keep a strict vigil that no harassment is inflicted upon the petitioner either at the behest of the private respondents or any other persons associated with the private respondents. With the aforesaid observation, WPA 24871 of 2024 is disposed of.
