In view of the settlement arrived at during the pendency of the appeal, the learned Counsel appearing on behalf of the appellant, on instruction, has submitted that the appellant is not willing to proceed with the matter.

The appellant is personally present in Court. He has also, in his deposition recorded in separate sheet, submitted that he is not willing to proceed with this appeal. Vakalatnama filed on behalf of the appellant is taken on record. Accordingly, the appeal stands dismissed for non-prosecution. All interim orders, if any, stand vacated.
