Petitioner is aggrieved by the fact that there has been no proper and fair investigation in respect of Habibpur Police Station Case No.325 of 2023 and Habibpur Police Station Case No.375 of 2023.

Petitioner is also aggrieved by the fact that his case is not being properly investigated which is Habibpur Police Station Case No.383 of 2023. The earlier two cases were instituted on the complaint of Jasoda Barman (Sarkar) and Ila Mandal (Roy) while the later case was registered on the information submitted by the petitioner.

Report submitted by the State reflects that charge-sheet has been submitted in connection with Habibpur P.S. Case No.325 of 2023 and Habibpur P.S. Case No.375 of 2023, so far as Habibpur P.S. Case No.383 is concerned, police authorities have submitted a final report as false. Subsequently, it is

reflected from the report two complaints were sent by registered post which were recorded as Habibpur P.S. Case No.10 of 2024 wherein also final report has been submitted as false and Habibpur P.S. Case No.11 of 2024 wherein also final report has been submitted as false. So far as the cases being Habibpur P.S. Case 383 of 2023, Habibpur P.S. Case No.10 of 2024 and Habibpur P.S. Case No.11 of 2024 are concerned, petitioner would be at liberty to approach the jurisdictional Magistrate if he is dissatisfied with the investigation praying for further remedies under Section 173 (8) of the Code of Criminal Procedure. With the aforesaid observations, WPA 24898 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
