The affidavit-of-service as filed in Court on behalf of the writ petitioners is taken on record.

The grievance of the writ petitioners in the instant writ petition is that the order dated 29.08.1991 as passed by a co-ordinate Bench of this Court in Civil Rule No. 4420 (W) of 1979 was not complied with.

On perusal of the Page No. 40 of the instant writ petition, it reveals that for such alleged non-compliance, one contempt application was filed being CPAN No. 2030 of 1999 which was disposed of as infructuous on account of non-appearance of the writ petitioners. 4.

Mr. De, learned Additional Government Pleader appearing on behalf of the respondent/State in his usual fairness submits before this Court that the respondent no. 2/authority may be directed to act in accordance with law.

In view of such, this Court while disposing the instant writ petition directs the respondent no. 2/authority to consider a copy of the instant writ petition as a

representation of the writ petitioners and after giving a chance of hearing to the writ petitioners and/or their authorized representative shall pass a reasoned order and shall forthwith communicate the same to the writ petitioners and/or their authorized representative preferably by email, if the email details of the writ petitioners are provided to him at the time of hearing. 6.

The entire exercise as indicated hereinabove is to be completed by the respondent no. 2/authority within 90 working days from the date of communication of the server copy of this order.

Liberty is given to the learned advocate on record for the writ petitioner to communicate the server copy of this order together with a copy of the instant writ petition along with all annexures to the respondent no. 2/authority forthwith.

The respondent no. 2/authority is hereby directed to act on the basis of the server copy of this order. 9.

The time limit as fixed by this Court is mandatory and peremptory.

10. With the aforementioned observations, the instant writ petition being WPA 23980 of 2023 is disposed of. 11.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
