Petitioner is aggrieved by the progress of the case. State has submitted a report. Let the report be kept with the record. Report reflects that till date charge has not been framed. The order dated 03.05.2023 reflects that the case was committed to the learned ADJ, 1st Court, Asansol which was again remanded back, as according to the learned sessions court, no ingredient of Section 409 of the Indian Penal Code was made out. Be that as it may, till date the charge has not been framed. The next date is fixed on 30th April, 2024. In view of the report of the concerned police personnel of Hirapur Police Station, I direct that the learned CJM, Paschim Bardhaman would take steps so that if it is not possible to consider the completion of the charges on 30th April, 2024, the same must be concluded by 31st May, 2024. The learned trial court after consideration of charges, if it feels that the trial of the case is warranted, in that case, it would fix one date in every 45 days so

that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournment be granted to any of the parties. In case any accused or witness is not present, immediate communication be made to the Officer-in-Charge/Inspector-inCharge of Hirapur Police Station who would ensure regarding the availability of the witnesses' concerned and would ensure the presence of the accused. Learned Public Prosecutor conducting the case would produce all the materials, documents and exhibits on the date so fixed for examination of the witnesses' concerned. All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, CRR 3961 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
