1. Affidavit-of-service filed in Court today is taken on record.

2. The petitioners have challenged the notice dated 13th August, 2024 issued by the Sub-Divisional Officer, Ghatal, Paschim Medinipur, being the respondent no. 6.

3. This Court finds that the Sub-Divisional Officer issued a notice of hearing to the petitioners but the petitioners have not appeared before the SubDivisional Officer and have filed the present writ application.

4. Accordingly, this Court finds that no purpose would be served by keeping the writ petition pending.

5. The writ petition is disposed of by directing the Sub-Divisional Officer to issue a fresh notice to the petitioners for hearing and if the Sub-Divisional Officer is relied upon any report of the Block Development Officer, the report be served upon the

petitioners. The petitioners are at liberty to take exception to the report, if any.

6. The Sub-Divisional Officer shall dispose of the proceedings within a period of six weeks from the date of receipt of copy of this order.

7. It is made clear that even after receipt of the notice, the petitioners fail to appear before the SubDivisional Officer, the Sub-Divisional Officer is liberty to take appropriate decision in accordance with law, in absence of the petitioners.

8. This Court has not decided the writ application on merits, all points are kept open.

9. Accordingly, WPA No. 24903 of 2024 is disposed of.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, with all necessary formalities.
