Claiming parity with the co-accused persons namely, Seikh Israil @ Isril and Estab Ali, who has been granted anticipatory bail in CRM(A) 2594 of 2024 on 14th August, 2024, the present petitioner has prayed for anticipatory bail. 2.

The learned Counsel for the State, does not dispute that the present petitioner stands on the same footing as that of Estab Ali. 3.

Accordingly, we are of the view that custodial interrogation of the present petitioner is not necessary.

Accordingly, we direct that in the event of arrest the present petitioner, namely, Sintu Sk @ Sentu Sk, hall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, subject to the satisfaction of the learned Chief Judicial Magistrate, Malda and also to comply with the conditions as laid down in Signed By :

Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita and on further condition that the petitioner shall appear before the jurisdictional court within two weeks from date and the petitioner shall not intimidate the witnesses or tamper with evidence in any manner whatsoever. It is further ordered that the petitioner shall appear on every date before the aforesaid Court on and from the date fixed for appearance of the accused. In the event of non-compliance of any of the conditions, the anticipatory bail shall stand automatically cancelled without any further reference to this Court. 5.

Accordingly, the prayer for anticipatory bail of the petitioner is allowed. 6.
