The petitioner is a teacher in Navodaya Vidyalaya Samiti, an autonomous organization under the Department of Central Education and Literacy, Ministry of Education, Government of India.

To ascertain whether the petitioner was serving in a sanctioned post or not, direction was passed upon the learned advocate for the Union of India to revert with instruction.

From the report forwarded by the Deputy Commissioner (I/C) of the Navodaya Vidyalaya Samiti, it appears that the petitioner worked in a substantive vacant post of TGT (Social Science/Studies) during the periods mentioned in the said report.

The petitioner prays for awarding marks for his previous teaching experience in the 2nd SLST. The recruitment process is ongoing.

The instant writ petition stands disposed of by directing the West Bengal Central School Service Commission to take a decision relying on the report forwarded by the Deputy Commissioner of Navodaya Vidyalaya Samiti and the other teaching experience of the petitioner. A decision shall be taken by the authority at the earliest.

The report filed on behalf of the Deputy Commission (I/C) of the Navodaya Vidyalaya Samiti be retained with the record. A copy of the report has been handed over to the learned advocate representing the Commission in Court today.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
