Mr. Tapash Kumar Bhattacharya Mr. Aviroop Bhattacharya ...for the petitioners Mr. Tapas Kumar Adhikari Mr. Tapas Ballav ...for the State It is the grievance of the petitioners that respondent nos.8, 9 and 10 have encroached upon a portion of a panchayat road running in front of the land owned by the petitioners. He has submitted that though several representations were made before Jhalda Gram Panchayat, Purulia, no steps have been taken by the said Panchayat in terms of Section 25(2) of the Panchayat Act, 1974.

Respondents nos.8 to 10 are not represented.

In view of the aforesaid facts made in the writ petition, I dispose of this writ petition giving a direction upon Jhalda Gram Panchayat, Purulia to consider the representation dated May 11, 2023 (appearing at page 48 of the writ petition) within a period of one month from the date of communication of this order.

The said Gram Panchayat shall give an opportunity of hearing to the petitioners as well as respondent nos.8 to 10 in arriving at its decision. A reasoned order should be passed by Jhalda Gram Panchayat within a period of one month thereafter.

Accordingly, WPA 24000 of 2023 is disposed of.
