Court no. 34

IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 3279 of 2012 In the matter of : Bachhu Kar & ors. ....petitioners. In Re : An application under Section 482 of the Code of Criminal Procedure.

Mr. Imran Ali .....for the State.

The revisional application was preferred challenging the proceedings arising out of Nabadwip P. S. Case No. 41/11 dated 02.03.2011 under Sections 498A/323/506 of the Indian Penal Code.

As none appeared on behalf of the petitioners or for the State, Mr. Imran Ali, learned advocate who ordinarily appears for the State is directed to appear in this matter for assisting the court. His appointment may be regularized by the concerned authorities in due course.

Record of this revisional application reflects that the investigation of the case was concluded and the investigating authority submitted chargesheet under Sections 498A/323/506/34 I.P.C.

The chargesheet reflects that 9(nine) witnesses were relied upon by the prosecution to prove its case. The present petitioners challenge the continuation of the proceedings. Having regard to the stage at which the petitioners approached this court, I am of the view that issues so raised are to be dealt with at the trial and no interference can be made at this stage of the proceedings.

Accordingly, the present revisional application being CRR 3279 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.

All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
