1. Let affidavit-of-service, as filed in Court, be kept on record.
2. The petitioner, as a member of the respondent no. 5, is aggrieved by the Board of Directors of such respondent transferring and/or encumbering properties belonging to the Society.
The representation made to the Assistant Director of Fisheries (Marine), Government of West Bengal, Diamond Harbour, District- 24 Parganas (South), respondent no. 2 herein, sometime in January, 2025, is yet to be disposed of.
3. The petitioner states that only after disposal of the representation made by him, by the respondent no. 2, the petitioner will be entitled to
take further steps under the West Bengal Cooperative Societies Act, 2006, namely the proceedings contemplated under Section 102 of the aforestated Act.
4. Petitioner further submits that the respondent no. 2 may be directed to dispose of the matter within a reasonable time, since hearing of the same was conducted on January 18, 2025, and in spite of letters of reminder by the petitioner's advocate thereof, as late as August, 2025, the respondent no. 2 has not taken any steps in respect of such representation.
5. Respondent no. 2 is directed to dispose of the representation within a period of four weeks from date, by passing a reasoned order thereof and to intimate the petitioner of such order.
6. With the aforestated direction, the writ petition is disposed of.
7. There shall, however, be no order as to costs.
8. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.
9.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
