The petitioner intends to construct a temporary stage (12ft. X 18ft.) and entrance gate (24ft. X 18ft.) at 67/50, Strand Road, near Somrasa Liquor Shop, Naabis Patty, Posta, Barabazar, near Jagannath Ghat, Kolkata 700 007 from October 27, 2025 to October 28, 2025 till 10.00 A.M. to organize Chhath Puja Mahotsav Seva Camp. Learned counsel for the State submits that the State has no objection if the temporary stage is constructed but the construction of the gate shall narrow the already congested road, which shall hamper free flow of traffic. I have considered the submissions made on behalf of the parties. This Court is of the view that construction of the temporary stage be permitted at the location stated by the petitioner from October 27, 2025 to October 28, 2025 till 10.00 A.M. in order to facilitate the petitioner to organise the Chhath Puja Mahotsav Seva Camp as admittedly conducted by them every year. However, this

Court does not find it necessary to grant permission for construction of the temporary entrance gate for the said purpose, more so, since construction of the said gate may hamper free flow of traffic at the already congested location.

In view of the above, the writ petition is disposed of allowing the petitioner to construct the temporary stage (12ft. X 18ft.) at the location stated by them from October 27, 2025 to October 28, 2025 till 10.00 A.M. The petitioner shall remove the said construction within 01.00 P.M. on the same date.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

There shall be no order as to costs.
