The petitioner as a member of the Scheduled Caste Community had participated in WBMCC "NEET-UG-Ayush," 2022 to pursue the „Bachelor of Ayurvedic Medicine and Surgery‟ and according to her merit position in the said test, she was allotted a seat at J.B. Roy State Ayurvedic Medical College & Hospital.

The petitioner has cleared the First Professional Examination of the said course conducted by the West Bengal University of Health Science, the respondent no. 7 herein.

The Sub-Divisional Officer(SDO), District24-Parganas (North) subsequently has detected that the Caste Certificate furnished by the petitioner at the time of admission in the said course was fake and accordingly cancelled it, owing to such cancellation, the College, by a letter dated September 10, 2025 has informed the petitioner that her studentship in respect of the said course is terminated with effect from September 09, 2025.

The petitioner is challenging the said communication.

Mr. Santi Ranjan Das learned advocate for the petitioner submits that an appeal against the said order of the SDO pending before the District Magistrate, 24-Parganas (North) he prays that the petitioner may be permitted to take up the 2nd Professional Examination scheduled to be held very soon.

There is no order of stay passed in the aforementioned appeal, therefore the prayer of the petitioner cannot be considered at this stage. WPA 24488 of 2025 is dismissed without any order as to costs.

In view of the dismissal of the writ petition, the application for expeditious hearing of the writ petition being CAN 1 of 2025 is also dismissed.
