C. O. No. 3581 of 2024 Shyam Prakash Singh and others Vs.

Pradip Rana and others Mr. M. S. Yadav, Ms. Saswati Chatterjee, Ms. Satabdi Naskar (Kundu) ... for the petitioners.

1. From the report furnished by the learned District Judge, South Parganas, it transpires that the application under Section 7(2) of the West Bengal premises Tenancy Act, 1997, filed in the suit from which the present revision arises, was disposed of by the concerned Court on February 17, 2025.

2. A review application was thereafter preferred against the said order, which was disposed of only on December 5, 2025.

3. It is pointed out by learned counsel for the petitioners at this juncture that the review application was filed in respect of a different order than the order dated February 17, 2025 and that the hearing of the review application was concluded long back in the month of April, 2025.

4. Be that as it may, we find that the said review application has since been disposed of and the suit was fixed for peremptory hearing on December 15, 2025.

5. Learned counsel for the petitioners apprises the court that thereafter the suit was again fixed on December 17, 2025 and again on January 7, 2026 for peremptory hearing.

6. Lastly, the matter has next been fixed on January 22, 2026.

7. Since the peremptory hearing of the suit has already commenced and evidence is continuing, this Court is of the opinion that, in all fairness, some further time ought to be given to the learned trial Judge to conclude the hearing of the suit and dispose of the same.

8. Accordingly, the learned trial Judge, that is, the learned Civil Judge (Junior Division), Sixth Court at Alipore, District- South 24 Parganas, is peremptorily directed to dispose of RC Case No. 98 of 2003 pending before the said court as expeditiously as possible, positively by the end of March, 2026.

9. It is further reiterated that this Court expects that the learned trial Judge shall, this time,

adhere to the timeline given by this Court and not exceed the same in disposing of the suit.

10. In the light of the above observations, CO No. 3581 of 2024 is disposed of without any order as to costs.

11. The learned trial Judge and all parties shall act on the basis of the communication of the learned Advocate for the revisionist petitioners, coupled with a server copy of this order, without insisting upon prior production of the certified copy of the order, for the purpose of compliance of this order.
