Mr. Gautam Banerjee ..for the petitioners Mr. Ranjan Saha ..for the State This petition has been filed by fifteen petitioners. Full court fees in respect of this matter have been paid and the document has been submitted which is kept on record.

The matter relates to refund of overdrawal amount for which the petitioners are aggrieved. After hearing the submission of the parties including Mr. Saha, learned advocate for the State and accepting his suggestion, I direct the Joint Secretary of School Education Department, Elementary Education Branch being the respondent no.4 to give an opportunity of hearing to the petitioners and to pass a reasoned order after considering all related Government orders and circulars in this regard within a period of eight weeks from date of communication of this order. The petitioners shall be given an opportunity of hearing when they will be at liberty to be represented by their

learned advocate. The reasoned and speaking order is to be served upon the petitioners by two weeks from the date of hearing. If it is found after such hearing by the respondent no.4 that the petitioners are not liable to repay the overdrawal amount such an order is required to be passed.

With the above observation and direction, this writ application is disposed of.
