We find that a Coordinate Bench, by an order dated August 27, 2024 passed in CRM (DB) 2318 of 2024, enlarged on bail a co-accused person by the name of Biswanath Ghosh.

The petitioner says that he stands on the same footing as Biswanath Ghosh. No specific role in the assault of the victim has been ascribed to the petitioner by the witnesses.

Learned Advocate for CBI, while opposing the prayer for bail, in his usual fairness, does not dispute that this petitioner is similarly circumstanced as the aforesaid Signed By :

Biswanath Ghosh, who has been enlarged on bail by this Court.

Hence, on the ground of parity, we allow the petitioner's prayer for bail.

Accordingly, we direct that the petitioner, namely RATAN HALDAR @ RATAN shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore, and on further conditions that he shall not leave the jurisdiction of the Titagarh Police Station except for the purpose of attending court proceedings and shall report to the Officer-in-Charge of the Titagarh Police Station once in a week until further orders.

The petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence and/or commit any cognizable offence in any manner whatsoever.

In the event the petitioner fails to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioner's bail in accordance with law without further reference to this Court.

The application for bail is, accordingly, allowed.
