Petitioner Mr. Dipanjan Dutta Mr. Ayan Chakraborty Ms. Sohini Mukherjee ... for the Petitioner Mr. Dutta, ld. advocate appearing for the petitioner, submits that the petitioner pursuant to the direction passed by the ld. appellate court by way of interim measure is not receiving any maintenance. Although the ld. Appellate court reduced the quantum of maintenance but directed that the same would be automatically vacated, if the husband/appellant do not pay the interim maintenance. Ld. advocate submits that the since the Lower Court Records have been called for, the petitioner is unable to take any steps before the ld. jurisdictional court/trial court. It has been informed that the next date has been fixed on 13th of December, 2023.

Having regard to the totality of the circumstances, I direct that the ld. Trial Court would complete the hearing of

the appeal by 15th of January, 2024 and pass its verdict by 31st of January, 2024.

With the aforesaid observations, CRR 3977 of 2023 is disposed of.

Pending application, if any, is also disposed of. Petitioner is granted liberty to canvass all the issues regarding the quantum which has been awarded by way of maintenance by the ld. Magistrate in the appeal pending before the appellate court.
