Sarkar ... for respondent no.25 One note has been placed before me by the Registrar General enclosing a letter of one Manik Bhattacharyya being the respondent no.27 whereby Mr. Manik Bhattacharyya prayed for appearing in person in this matter. Mr. Manik Bhattacharyya is in custody in some other matter. This court can grant him liberty to engage any lawyer if he so wishes through legal aid, if he has any financial problem, but an under trial prisoner
cannot be allowed to appear before this court for appearing in person. This order may be communicated to said Mr. Manik Bhattacharyya by the Registrar through the Superintendent of Presidency Correctional Home. Today University Grants Commission and University of Calcutta have filed their respective affidavits which are kept on record. Affidavit in opposition on behalf of the State has been filed in the department. I direct the department to send the said affidavit to this court in course of the day.
Affidavit in opposition on behalf of the respondent no.25 has also been filed today.
I direct the respondent no.25 to supply a copy of this affidavit upon all the appearing parties in course of the day.
Learned advocate for the College Service Commission has come up with an affidavit which is not required by this court at this point of time because they have already filed one report in the form of an affidavit. If necessary I will direct the College Service Commission to file an affidavit on respective issues.
Due to paucity of time this matter cannot be heard today. It will appear for further hearing tomorrow at 2 p.m.
