Ct. 238 Mr. Lakshmi Bhattacharya ...for the Petitioner Mr. Nilanjan Adhikari, Mr. Dyutiman Banerjee ...for College It is the grievance of the petitioner that her deceased husband graciously donated a plot of land, on which the building of the relevant college namely, Gour Mohon Sachin Mondal Mahavidyalaya was constructed. It is an admitted position that the college has been named after the late husband of the petitioner recognising his contribution towards establishment of the college. The petitioner submits that she approached the Principal of the College for installing a half-bust statue commemorating her late husband in the college premises. Regrettably, the Principal of the College declined such request and engaged in discourteous behaviour. The petitioner now seeks a mandamus upon the college for installation of a half-bust statue of the petitioner's late husband in the college premises. Such prayer cannot be entertained by a writ court. Unless there is a statutory right and corresponding legal obligation, no writ of mandamus can be issued.

However, I make it clear that disposal of this writ petition should not impede the consideration of the proposal for installation of statue of deceased husband of the petitioner in the college premises by the Governing Body of the College.

Accordingly, WPA 24025 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
