CESC Limited and others Mr. Dulal Dey .... for the petitioner Ms. Sreemoyee Mitra .... for the CESC Limited Learned counsel for the petitioner submits that due to the obstruction created by the respondent nos.2 to 6, the CESC Limited is not considering the petitioner's request to shift the electricity meter of the said private respondents, which is creating safety hazards for the petitioner.

Learned counsel for the CESC Limited submits that no formal application has yet been made for shifting the meter.

However, it transpires that the petitioner, not being the owner of the electricity connection given from the meter-in-question, does not have any locus standi to make an application for such shifting, unless the private respondents join in.

Unless the private respondents are heard, it is not possible to ascertain whether they are agreeable to such shifting of meter.

Hence, WPA No. 24441 of 2022 is disposed of by granting liberty to the petitioner to apply formally for shifting of the electricity meter of the private respondents, situated within the premises of the petitioner.

If such a formal application is made, the CESC Limited shall process the same expeditiously, if necessary upon ascertaining the feasibility of such shifting, upon hearing the version of the respondent nos.2 to 6, if need be.

This court has not gone into the merits of the case and it will be open to the CESC Limited, upon such application being made, to decide the issue in accordance with law.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
