On the last date of hearing, learned counsel for the opposite parties had appeared and sought an adjournment as the learned counsel Pratip Mukherjee was not available. Learned counsel submits that there was no representation on behalf of the petitioner on 7th October, 2024 as learned counsel for the petitioner was busy in another court. 3.

An application for condonation of delay of 107 days has also been moved. Learned counsel submits that as wife of the petitioner was seriously ill, the delay took place.

In view of the submission made the delay is condoned and restoration application is allowed. 5.

Accordingly, CAN 4 of 2025 and CAN 5 of 2025 stands disposed of.

Let the matter be listed in the combined monthly list of January, 2026.
