None appears for the State Authorities despite service of notice.

Mr. Dey who usually appears for the State Authorities and is present in Court is requested to represent the State Authorities in the matter. His appearance be regularised by the Legal Remembrancer.

The grievance of the petitioner is that a portion of his land was earlier acquired by the State Authorities for construction of Lalat-Janka Road but no compensation was granted to the petitioner for the same despite assurance by the authorities. Recently the State Authorities have again lime marked a portion of the petitioner's property for the extension of the road in question without acquiring the said land in accordance with law.

The petitioner submitted a representation before

the respondent No. 3 on 13th September, 2019 ventilating his grievance, but the said representation has not been considered till date.

The petitioner prays for a direction upon the respondent no. 3 to consider and dispose of the said representation.

Upon considering of the submissions made on behalf of the parties and material on record, the writ petition is disposed with a direction upon the respondent no. 3 to consider and dispose of the representation filed by the petitioner on 13th September, 2019 after affording reasonable opportunity of hearing to all the affected parties including the petitioner or his representative, within a period of four months from the date of communication of this order, in accordance with law. The order should be communicated to the petitioner within a week thereafter.

WPA No. 22387 of 2019 is disposed of accordingly. There shall be no order as to costs.

Since no affidavit -in-opposite has been invited, the allegations made in the writ petition are deemed not to be admitted.

Urgent certified website copies of this order, if applied for, be supplied to the parties expeditiously on compliance with the usual formalities.
