For the Respondent no. 6 Affidavits submitted by the petitioner and the 6th respondent and the report submitted by the State are taken on record.
In the affidavit filed by the petitioner, the petitioner has undertaken not to dispossess the 6th respondent from the flat in question without due process of law. On the other hand, the 6th respondent, in the affidavit filed by her, has undertaken to allow the petitioner and his wife to stay in the flat.
The 6th respondent has lodged FIR against the petitioner and his family members. Charge sheet has been submitted therein upon completion of investigation. She has also filed an application under the Protection of Women from Domestic Violence Act which is pending.
However, in view of the undertakings given by the parties, the petitioner shall not dispossess the 6th respondent from the flat in question without due process of law. Also, the 6th respondent shall allow the petitioner, his wife and son to enter the flat and reside therein peacefully without any disturbance whatsoever.
The police is directed to keep strict vigil in the area in order to avoid breach of peace. Any assistance sought by the parties shall be looked into by the police authority without delay.
The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
