Affidavit-of-opposition filed on behalf of the opposite party be kept with the record.

The instant application is filed on being aggrieved by the order passed by the Learned 10th Judicial Magistrate at Alipore, South 24-Parganas. The point of grievance is that the learned Trial Court allowed interim maintenance of Rs. 10,000/- per month for the minor son, but, no interim maintenance was allowed for the wife.

It is submitted that the wife is an advocate practicing in Alipore Judges Court.

I have heard the learned Counsels. After adducing evidence the learned Trial Court shall decide upon the quantum of maintenance payable either to the wife or to the minor son or to both at the present. There is no need to interfere with the present order dated 12.06.2024.

However, the learned Court can modify the order in case of change of circumstances, if so applied for.

In a nutshell, the impugned order is not interfered with. The instant application stands disposed of accordingly. Urgent certified photocopy of this order, if applied for, shall be supplied to the parties upon compliance of all necessary formalities.
