Affidavit of service filed by the petitioner is taken on record.

None appears for the private respondent despite service.

Learned counsel for the petitioner submits that the petitioner purchased the property in question from the 8th respondent and is possessing the same. The 8th respondent tried to disturb his peaceful possession in respect of the property for which a civil suit was filed by the petitioner which is pending. The private respondent also assaulted the petitioner and tried to oust him from the property for which complaint was lodged by him before the Inspector in charge, Amdanga Police District, SDPO, Barasat and the Superintendent of Police, North 24 Parganas.

The petitioner complains that no step has been taken by the police authority pursuant to his complaints. On prayer of the petitioner, liberty is granted to take necessary

steps before the learned jurisdictional Magistrate for redressal of his grievance.

In the event the petitioner files an appropriate application before the learned Magistrate, the learned Magistrate shall take necessary steps in accordance with law.

With the aforesaid observation and direction, the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
