Bhudeb Chandra Biswas Ct-08 ar The appeal appeared in the warning list on 29th November, 2022 with a clear indication that the same shall be transferred to the regular list on 5th December, 2022, since then the matter is appearing in the list.

Pursuant to our earlier direction the stamp reporter has filed revised report dated 02.01.2023.

From the revised report it shows that the statutory period of limitation has expired on 28.10.2010 and the deficit court fees was put in on 27.7.2011 was beyond the statutory period of limitation by 272 days.

Today none appears on behalf of the appellants.

The instant appeal filed on 04.10.2010.

In absence of filing any application for condonation of delay and the acceptance of delayed deficit court fees, which was beyond the statutory period of limitation, the appeal stands dismissed.

There will be no order as to costs.
