The application under Section 439(2) of the Code of Criminal Procedure was advanced before this court for cancellation of bail of the opposite party no. 2, Souvik Mukherjee.

In view of the allegations made, a report was called for from the Officer-in-Charge, Dum Dum Police Station. Today a report has been submitted before this court by the Inspector-in-Charge, Dum Dum Police Station, BKP Commissionarate through the learned advocate for the State. Let the same be kept with the record. The report reflects that a surveillance was kept upon the accused/opposite party no. 2 for one month and nothing adverse could be found against him.

Having considered the report so submitted by the Inspector-inCharge, Dum Dum Police Station, I am of the opinion that at this stage the prayers so advanced by the petitioner cannot be acceded to. If circumstances so warrant, the petitioner would be at liberty to take out

an appropriate application before the jurisdictional court who is in seisin of the matter.

With the aforesaid observations, the application for cancellation of bail being CRM (SB) 271 of 2022 is disposed of. All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court. . [Tirthankar Ghosh, J]
