APP Mr. Arani Bhattacharyya ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been implicated only on the basis of statement of a co-accused and is in custody for 103 days, as such, on any stringent condition, the petitioner may be enlarged on bail.
Learned advocate also submits that trial court has fixed next date for supply of copies.
Learned advocate for the State opposes the prayer for bail and submits that the petitioner has been absconding for about two years, thereafter, he was arrested. Having considered the same, I am not inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Rejected.
However, the learned trial court is directed that after consideration of charges, the petitioner may be released on bail on such conditions as the learned trial court deems fit and proper for ensuring further appearance of the accused/petitioner before the learned trial court. Accordingly, CRM(NDPS) 1360 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record.
