1. The petitioner is an unmarried daughter of a retired teacher, late Pramatha Nath Chakraborty, who worked under the WBBPE. After the death of the father, her mother received pension. The mother died on 02.12.2018. In terms of the decision of the Special Bench in the case of State of West Bengal Vs. Sabita Roy, it is now settled that an unmarried daughter is entitled to get pension.

2. In those circumstances, the petitioner shall be entitled to get pension.

3. The concerned DPPG shall issue Pension Payment Order to the petitioner and pay pension to the petitioner with effect from 13.12.2018.

4. It is expected that Pension Payment Order shall be issued within one month from date by the concerned DPPG.

5. Let a copy of this order along with a copy of the writ petition be communicated to the concerned DPPG forthwith. The arrears of pension shall be paid to the petitioner within three weeks from date.

6. The writ petition is disposed of.

7. There will be no order as to costs.

8. All parties are to act on a server copy of this order duly downloaded from the official website of this court.
