On the submission of the learned advocate for the respondent nos. 5 & 6, the direction upon the CESC dated August 5, 2024 is reiterated in this order. The CESC has already held an inspection for the purpose of granting connection to the petitioner. CESC will grant connection through a loop meter from the existing meter board position. The landlady is present before the court, through learned Advocate.

The landlady submits that the petitioner is an illegal occupant.

The court does not decide the issue of status of the petitioner. This order shall not be construed as a stamp

of legality on the nature of occupation of the petitioner. The landlady can take appropriate actions to evict the petitioner from the premises.

Any connection that may be given shall not create any equity and shall be subject to the outcome of any proceeding that may be initiated by the landlady, against the petitioner.

If the respondent nos. 5 and 6 obstruct the CESC authorities in performance of their duties as directed by this court, the police authority shall take necessary action, including breaking open the padlock, so that the CESC can access the meter at the cost of the petitioner. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
