Petitioner is aggrieved by the manner in which Sonarpur Police Station Case No.1140 of 2024 dated 20th August, 2024 has been progressing. Prima facie, it reflects that accusations made are for cheating and forgery.

Report submitted by the State reflects that police authorities have recorded statement under Section 180 of BNSS and has also called for report from the BL & LRO, Sonarpur regarding the actual ownership of the scheduled land. So far as the accused persons are concerned, prima facie, it reflects that the accused persons are absconding.

Police authorities are directed to apply before the jurisdictional Magistrate in seisin of the matter praying for harsher process of law in order to trace out the absconding accused persons. The concerned

Magistrate will assess regarding the prayers advanced by the Investigating Officer particularly with the regard to the accused persons evading the process of law and pass necessary orders. Efforts be taken by the police authorities to issue reminders to the BL & LRO regarding the ascertainment of the ownership of the property-in-question which is the subject matter of the case. Police authorities would take effective steps so that the investigation of the case is taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, WPA 24955 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
