Pursuant to an order passed by this Court on 22nd August, 2023 in W.P.A. 20027 of 2023 directing the District Magistrate, Purba Bardhaman to consider and dispose of the representation submitted by the petitioners within a stipulated time frame, notice of hearing was served upon the petitioners on behalf of the District Magistrate, directing the petitioners to attend the hearing scheduled to be held on 27th September, 2023. Learned counsel for the petitioners submits that though the petitioners appeared before the authority on the said date, the District Magistrate, Purba Bardhaman was not present at the hearing.

The said contention is denied and disputed by the respondents.

Be that as it may, since the representation submitted by the petitioners is yet to be considered, the District Magistrate, Purba Bardhaman, being the 2nd respondent herein is directed to consider and dispose of the representation within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
