Adil Badr Mr. Sanchit Talukdar ... for the State Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Other coaccused has surrendered before the jurisdictional court and was granted bail.

Learned counsel for the State opposes the prayer for anticipatory bail, refers to an order dated 14.10.2025 passed by the ACJM-2, Kolkata and submits that the court entertained affidavit filed on behalf of the petitioner, which was kept on record and called for a report from the investigating officer without insisting upon taking the said accused into custody. On merits, there are statements of witnesses including the victim implicating the present petitioner. Assault was done with brickbat and stick. The injury report shows that the victim suffered injuries on different parts of the body like above the eyelid.

Considering the materials available in the case diary, the statement of the victim and the injury report showing several injuries including cut injury above left eyelid and the fact that the injuries were allegedly caused with brickbat and stick, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
