1. The affidavit-of-service as filed today is taken on record.

2. The grievance of the writ petitioner in the instant writ petition is that though the writ petitioner is using the plot of land belonging to the Irrigation and Waterway's Department, particulars of which have been mentioned in paragraph 3 of the instant writ petition for a considerable length of time, the respondent no.3 authority is not granting any lease in respect of the said plot of land in favour of the writ petitioner despite submission of the representation of the writ petitioner on 04.09.2023.

3. In view of such, while disposing the instant writ petition this Court directs the respondent no.4 authority to consider the representation dated 04.09.2023 as submitted by the writ petitioner in accordance with law after giving an opportunity of hearing to the writ petitioner and/or his authorized representative and shall pass a reasoned order and shall forthwith communicate the same preferably by

email to the writ petitioner, if the mail detail of the writ petitioner is furnished to him at the time of hearing.

4. The entire exercise as indicated hereinabove is to be completed within 90 working days from the date of communication of the server copy of this order.

5. The respondent no.4 authority is directed to act on the server copy of this order.

6. Liberty is given to the learned advocate on record to communicate the server copy of this order to the respondent no.4 for his due compliance.

7. With the aforementioned observations WPA 24077 of 2023 is disposed of.

8. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
